These Terms of Service ("Terms") govern your use of wystepekdigital.com (the "Site"), operated by Wystepek Digital Company, a division of Wystepek Ventures, LLC ("WDC," "we," "us," or "our"). By accessing or using the Site you agree to these Terms. If you do not agree, please do not use the Site.

1. Use of the Site

You may use the Site for lawful purposes only. You agree not to:

• use the Site in any way that violates applicable law or regulation;
• attempt to gain unauthorized access to the Site, its admin area, servers or databases;
• interfere with or disrupt the Site, including by introducing malware or by automated scraping that places an unreasonable load on it;
• submit false, misleading, infringing, harassing, hateful or unlawful content;
• use the Site's forms to send spam or unsolicited advertising.

2. Comments and submissions

If you post a comment or send us a message, you are responsible for its content. You confirm that you have the right to submit it and that it does not violate anyone's rights or the law.

All comments are moderated before publication. We may approve, edit for length or formatting, decline or remove any comment at our sole discretion and without notice. By submitting a comment you grant WDC a non-exclusive, royalty-free, worldwide license to display, reproduce and distribute that comment on the Site and in connection with our services. Do not include personal or confidential information in a comment.

3. Intellectual property

The Site and its content, including text, graphics, logos, the "WDC" and "Wystepek Digital Company" names and marks, designs and code, are owned by WDC, Wystepek Ventures, LLC or our licensors and are protected by intellectual-property laws. You may view and print pages for your personal, non-commercial use. You may not copy, modify, distribute or create derivative works from Site content without our prior written permission.

Portfolio items marked as samples or placeholders are illustrative concepts and do not represent actual client engagements.

4. Information on the Site; no offer

Content on the Site, including service descriptions, process descriptions, timelines, blog articles and any pricing, is provided for general information only. Pricing shown is "starting at" pricing for typical scopes, is subject to change without notice, and does not constitute an offer or a binding quote. Any services we provide will be governed by a separate written proposal, statement of work or services agreement signed by both parties. If that agreement conflicts with these Terms, the agreement controls for those services.

5. Services disclaimer

While we work hard to deliver excellent results, we do not guarantee specific outcomes from any website, app, search-engine-optimization, Google Business Profile or marketing work, including search rankings, traffic, leads, sales, revenue or app-store approval. These outcomes depend on many factors outside our control, such as search-engine and app-store policies, competition and market conditions. Blog articles reflect general guidance and are not legal, tax, financial or other professional advice.

6. Third-party services and links

The Site may contain links to, or integrations with, third-party websites and services. We do not control and are not responsible for their content, policies or practices. Your use of them is at your own risk and subject to their terms.

7. Disclaimer of warranties

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE OR FREE OF HARMFUL COMPONENTS.

8. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WDC, Wystepek Ventures, LLC AND THEIR MEMBERS, MANAGERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

9. Indemnification

You agree to indemnify and hold harmless WDC and Wystepek Ventures, LLC from any claims, damages, losses and expenses (including reasonable attorneys' fees) arising from your misuse of the Site, your submissions, or your violation of these Terms.

10. Governing law and venue

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-law rules. You agree that any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in or serving Fayette County, Pennsylvania, and you consent to the personal jurisdiction of those courts.

11. Changes and termination

We may modify these Terms at any time by posting the updated version on the Site and changing the "Effective date" above. Your continued use of the Site after changes take effect means you accept them. We may suspend or restrict access to the Site at any time.

12. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. These Terms, together with our Privacy Policy and Cookie Policy, are the entire agreement between you and us regarding the Site.
